The U.S. Supreme Court Further Delays the Texas Migrant Arrest Law from Entering into Effect

On March 12th, 2024, U.S. Supreme Court Justice Samuel Alito issued a second stay preventing Texas from implementing Senate Bill 4. The law, dubbed the “show me your papers” law, grants Texas law enforcement the power to arrest individuals suspected of illegal entry and allows judges to order deportation without prosecution. Justice Alito’s stay will last until 5:00PM on March 18th.

The law had previously been temporarily blocked by a lower district court for overstepping federal immigration authority, but the Fifth Circuit granted a temporary stay of that decision. The Biden administration, along with nonprofit organizations and El Paso County, challenged the law, leading to Justice Alito’s latest stay.

The legal battle surrounding the law is still ongoing, with oral arguments scheduled for April 3rd at the Fifth Circuit. Texas argues that the law does not conflict with federal immigration law, as it only requires noncitizens to be transported to a port of entry and allows for self-deportation.
