Texas Judge Stops the Texas’ Migrant Arrest Law
Thursday, February 29th, 2024, a Texas federal judge blocked a state law allowing the arrest and deportation of migrants, ruling that states cannot enforce immigration laws without federal consent. This decision puts Senate Bill 4 (S.B. 4) on hold during ongoing litigation.
S.B. 4 is the law that grants state and local law enforcement the power to arrest suspected illegal entrants and permits judges to order deportation without prosecution. S.B. 4, also called “Show Me Your Papers” law, was set to take effect on March 5.
The judge’s ruling emphasizes that Texas cannot unilaterally supersede federal immigration directives. This development underscores the constitutional framework governing immigration enforcement.
